Mediclaim policy basically covers :
1. Hospitalization expenses.
2. Pre and Post Hospitalization expenses.
3. Maternity Benefit (For Group policies)

Your wife has been hospitalized under the policy period of IFFCO Tokio and subsequently your new born Baby was placed in NICU for treatment.

In the above case, claim for Hospitalization expenses upto 31st August 2011 and Pre-hospitalization expenses will fall under IFFCO's policy.

From 1st September 2011 all expenses will have to be claimed under Oriental Insurance Policy.

Remember you would have to obtain documents from hospital in duplicate (prescription, Bills, receipts, Discharge Summary, Medicinine Bills etc) and also get it duly certified by them, since Oriental's TPA would ask for the same.

Best Part here is that our TPA for IFFCO and Oriental are same so there should not be much of problem.

Regarding Post Hospitalization expenses if your wife and baby are discharged from hospital after 1st September 2011 then all the expenses will fall under Oriental's policy.

For detailed assistance u may sign-up at our Free Claims Counseling section.

May your wife and child recover soon.
Good Luck !!!

From above it is gathered the coverage is port A to Port C with transhipment in Port B, and the cargo has been hijacked before it could reach Port C, the final destination. for which you have made a claim upon the insurer which has been declined.

Based upon the priliminary information as above, we feel the stand taken by insurer is not justified and you should represent your case before you approach any legal forum.

Hi all,

I would like an experts point of view.

I have a Marine Cargo Policy which has ICC "A" coverage. On the policy, it has From : Port A To Port C with Transhipment in Port B. Coverage is Port to Port only.

During the voyage, in port B, the goods left the port vicinity to do re-stuffing of different containers as the containers that are from Port A are not of International standard and therefore needs to be moved to an international certified container. During the course of returning to the port to be sent to the final destination, a third party hijacked the container.

The insurer has rejected my claim based on the fact that it has left the port and the coverage is "Port to Port Only". Is this true? Or is there a definition of "Port to Port" as to my understanding, Port to Port refers to the original destination to the final destination. Is there any definitions or Case law that might be able to help me?

Thanks

The claim has been repudiated apparently due to "Inherent Vice". That is, leather gloves shipped has inherent moisture (presumably higher than prescribed for the voyage)which evaporated and condensed on the ceiling of the container. The water droplets subsequently dropped on to the cargo causing the water damages.
The claim can be challenged as the insurer, in All Risks, has the onus to prove that the cause of damage was inherent vice.

Hi,
I lost my father in a road accident last year. His driving license along with other important documents was lost at the accident site. I have filed a missing report at the concerned police station and also in the leading newspaper.
Now at the time of claiming the insurance, the insurance is asking for the driving license and saying that the claim will not be passed unless a copy of the DL is presented.
I have no record of my fathers Driving license number or anything.
Please advice me on how to proceed further. Is a life insurance claim really null without a driving license.
Please Help..
Thanking you in advance.
Sumbul.

Dear Mr. Kabra & Devanand,

Thank you so much for the replies.

She was admitted on 05.10.10 and delivery took place on same day. According to your advise, i may need to claim the pre-natal expenses only with IFFCO, where the main bill is settled.

Prior to submission of claims, i have called ICICI Customer Care and they have completely mis-guided me.

I am not even having the Call Reference to prove that they have mis-guided me. My concern is not about the money, but only about their inproper guidance.

However, thanks again for your valuable advises.

Mr. Kumar,

Kabra have rightly pointed "the date of admission" is most important in such cases.

Note the claim for pre-natal expenses will fall in that policy period under which the hospitalization has taken place.

To explain you further, there could be only two situation :-
1. your wife was admitted in a hospital on or before 20.09.10 or
2. She was admitted after 20.09.2010.

In case of situtation no. 1:

You would be entitled to claim from ICICI, your previous insurer the Main Bill as well the Pre-natal expenses, since she was hospitalized before the date of expiry of ICICI policy i.e. midnight of 20.09.2010 . But

In case of situtation no. 2:

You would not be entitled to claim any amount from ICICI, be it Main Bill or pre-natal expenses, since your wife was hospitalized after the date of expiry of ICICI policy but under a new policy period that of IFFCO.

Therefore, please note you are entitled to claim this pre-natal expenses along with Main Bill from IFFCO, but to the extent of the policy terms agreed between your employer and IFFCO.

warm regards

Mr. Prabhu Kumar,

What could be gathered from above is that:
1) On 05.10.10 your Wife delivered a Baby.
2) U want Pre-natal expenses reimbursement for Rs. 9749/-
3) ICICI has refused since Main bill is not settled by them.
4) under Iffco policy you will loose Rs. 7500/-

Mr. Kumar, the most important point you missed to state is the date when your wife was hospitalized.

- Is it on 20.09.2010 or thereafter?

Hi, My self and my family are covered under Floater Policy of my Employer with ICICI Lombard (TPA - iHealthcare) valid upto 20.09.10.

* From 21.09.10 my employer has switched over to IFFCO Tokio

* On 05.10.10 my Wife has delivered a Baby

* Amount of Rs. 43,000/- Hospitalisation. Claim submitted to IFFCO Tokio (TPA - Medi Assist)

* Amount of Rs. 9749/- towards Pre-natal Expenses (i.e. Expenses spent during ICICI policy is valid from Jan. 10 to Sep. 10). Claim submitted ICICI according to the directions given by ICICI customer care.

* Maternity Claim limit in both policies are Rs. 50,000/- inclusive of Pre,Post and Hospitalisation charges.

* Now, ICICI is rejecting the claim stating that reimbursement of Pre-natal can be given only in case of Main Bill is settled by ICICI.

* If i need to claim these Pre-natal charges with IFFCO Tokio, this policy has restriction of paying only 30 Days charges prior to Delivery. In such case i will loose Rs. 7500/- out of Rs. 9749/-.

* In case of ICICI Policy there is such restriction.

Kindly advise in this regard.

The cause of decline of claim is possibly due to the fact that damages took place due to condensation. Condensation means the moisture in the air being precipatated on the cargo / containr walls due to variation in temperature / inadequate ventilation etc. It is inherent vice and hence not covered.

a. Port Receipts & Landing Tally Remarks -Port Authorities
b. Statement of Facts -Vessel Captain
c. Damage/ Short Landing Cert. - Shipping Lines
d. Pre and Post inspection report - Conatiner Provider
e. Damage Cert. -inland transporter, BL copy - FW Agent

The possible reason for damage could be rainwater, seawater entry into container or water generation inside the container as a result of Container Condensation

Hi Friends,

Looking for assistance.
Brief fact of the case is as under.

i had sent a consignment of Leather gloves (packed in cardboxes) from Kolkata-Paradip port to Chile (Valpriaso port) through sea using a general purpose container in July 09.
Cargo was in transit for about 3 months involving 3 different transhipment ports & vessels.

when the cargo reached destination the seal of the container was found intact & the container was also found apparently in good condition from outside.

But when the container was opened at the destination (factory in chile) it was found that the cardboxes containing leather gloves (packed in polybags with selica gel & anti-fungus capsules)were found wet & damaged.

the above consignment was insured wide transit insurance all risk policy. on intimation to the insurer about the loss for settlement of the claim. They declined the claim for want of evidence.- How did the consignment got wet.?

would appreciate if anybody can suggest what documentary proof can be helpful from the following parties;-

a. port authorities - ( 3 transhipment ports involved)
b. vessels captain - ( 3 vessels involved)
c. Shipping line

For the reason of non-compliance of policy condition/ warranty, claims can be settled on non-standard basis i.e 75% of the assessed claim amount is paid by the insurer.

Also note it is the discretion of an insurer whether at all to pay or not for the claim where there is any breach of policy condition, if they decide to entertain the claim it is generally processed on non-standard basis.

However, in your case it was demand of the situation and compulsion for you to remove the car to avoide further loss to the insured vehicle or "Total Loss" of the vehicle and safe guard human life and not intentional that the spot survey was foregone.

In view of the above, you can make a personal as well official representation to the grievance department of the insurer with your contention for their review of the claim.

Get in touch with ur agent. insurance company and know the reason for delay / non-settlement

The delay may be on 2 counts:
1. File processing unattended
2. Claim settlement pending often want some document or clarification from your side.
